Terms Of Use

These Terms and Conditions apply to all Cubabien Travel Packages.

1. Rates
Published PACKAGE fees are based on hotel and air only, and do not include U.S. domestic airfare. Transportation in Cuba related to the PACKAGE is not included. Land-only rates are guaranteed upon receipt of deposit. Printed rates are subject to change without notice.  Cubabien also provides Cuban tourist visa, and other airport related services for a fixed fee, called FLIGHT PACKAGE.  Flight package prices are subject to change unless accompanied by a confirmed booking. 
2. Registration & Payments 
The PARTICIPANT has agreed to pay the applicable PACKAGE fee in consideration of Cubabien Travel providing the opportunity for the PARTICIPANT to participate in Cubabien PACKAGE, inclusive of accommodations and other services for the PARTICIPANT as set forth below. A $200 non-refundable deposit is due at the time of registration. The remainder of the fee and Flight Package cost is due 60 calendar days prior to the date that the PARTICIPANT is scheduled to arrive in Miami or Cuba, depending on the tour start location. If payment in full for PACKAGE fee and/or Flight Package is not received on or before the due date, the PARTICIPANT’s PACKAGE may be cancelled.
3. Cancellation & Refund Policy 
Cubabien reserves the right, in its sole discretion, to reject an individual at any time prior to departure, or to cancel the Cubabien PACKAGE in which a PARTICIPANT is scheduled to participate. In the unlikely event of such a cancellation by Cubabien, or if a PARTICIPANT has been rejected, the total amount paid to Cubabien (less airfare) will be refunded, unless the cancellation is due to non-payment of the PACKAGE fee and/or Flight Package by the PACKAGE fee’s due date or is due to governmental action beyond Cubabien controls, in which case the amount refunded will be reduced to the extent Cubabien has incurred expenses in organizing the PACKAGE. Other than such a refund, Cubabien will not be responsible to a PARTICIPANT for any other refund, costs, interest, liability or damages of any kind.
If PARTICIPANT cancels for any reason, he or she must notify Cubabien in writing. The cancellation will be effective upon Cubabien receipt of the written notification at its office in Miami, Florida. Cubabien incurs substantial administrative and planning costs prior to the departure of PARTICIPANT. Therefore, regrettably, if PARTICIPANT cancels his or her participation in the PACKAGE, funds paid by PARTICIPANT to Cubabien can be refunded only as set forth below.
The $200 deposit is non-refundable. PARTICIPANT may apply this deposit to another Cubabien PACKAGE to be scheduled to depart within 365 days of the original scheduled start date, subject to space availability.
If the cancellation is effective
61 days or more prior to the scheduled start date, the Fee and Flight Package costs paid, not including the deposit and any applicable airline cancellation penalties, will be refunded;
60 to 45 days prior to the scheduled start date, 50% of the Fee and Flight Package costs will be retained, and the balance, not including the deposit and any applicable airline cancelation penalties, will be refunded;
44 to 31 days prior to the scheduled start date, 75% of the Fee and Flight Package costs will be retained, and the balance, not including the deposit and any applicable airline cancelation penalties, will be refunded;
30 or fewer days prior to the scheduled start date, none of the Fee or Flight Package costs will be refunded.
If PARTICIPANT cancels his/her program and chooses a refund, PARTICIPANT will forfeit the future use of his/her deposit. 
No refunds will be made for unused portions of the PROGRAM for any reason. Flight package costs are non-transferable. 
PARTICIPANT is responsible for transportation costs to the start location in Miami or other designated gateway city. The PARTICIPANT is also solely responsible for any airfare or other travel fees, charges, expenses or penalties that might result from any cancellation of or change in the PARTICIPANT’s PROGRAM, whether the PARTICIPANT cancels the PROGRAM or it is cancelled or altered by Cubabien.  
It is very important that a PARTICIPANT understands the cancellation policy. If it is not clear, the PARTICIPANT should ask for clarification. Cubabien cannot make exceptions to this cancellation policy for any reason. Cubabien STRONGLY URGES THE PARTICIPANT TO UPGRADE AND/OR PURCHASE ADDITIONAL TRIP CANCELLATION INSURANCE.
Cancelation policies for flight only 
You always can cancel your reservation with Cubabien Travel; this will have a cost of $100 fee that will not be return. 
4. Changes to Registration 
Changes to type of PROGRAM or start date by participant are considered a cancellation and are subject to the Cancellation and Refund policy found herein. Participant changes may be subject to additional airline or hotel fees should the original rates no longer be available for your revised travel dates. Revisions to air tickets are subject to the airline fare rules, change fees, and cancellation policies. Air prices may vary depending on the day of travel, gateway city, routing, and airline class of service booked, which is determined by seat availability.
5. CHARTER FLIGHT ARRANGEMENTS TO CUBA
Direct flights to Cuba from the U.S. are operated by an OFAC-authorized Carrier Service Provider (Charter Company) and are arranged by an OFAC- authorized Travel Service Provider (TSP).  Charter flight times are authorized on a monthly basis by the U.S. Department of Transportation, the Cuban Government, and the Office of Foreign Assets Control.  Cubabien receives authorized flight times 15-45 days before departure.  Cubabien strongly encourages PARTICIPANTS to wait until flight times are communicated to make domestic flight arrangements. Cubabien is not responsible for any missed, delayed or cancelled flights.
6. PASSPORTS & U.S. AND CUBAN VISAS
The PARTICIPANT is required to have a passport valid for six months after the return from their Cubabien packages.  PARTICIPANTS holding a passport from a foreign country; green card, U.S. visa, or special-use passport are solely responsible for understanding the limitations imposed on their passport, green card, U.S. visa, or special-use passport regarding re-entry back into the United States. Cubabien cannot be held liable for a PARTICIPANT who is refused service by the Carrier Service Provider or entry into Cuba because of a restricted U.S. visa or Passport or denial of a visa by the Cuban government.  In the event the PARTICIPANT is refused entry to Cuba because of Visa or Passport issues or denial of a visa by the Cuban government, applicable cancellation penalties may apply.
PARTICIPANT is responsible for having on his or her person proper documentation to enter Cuba as well as to re-enter the United States, and proper documentation to travel via a third country (if applicable) to Cuba. For certain categories of travel, a TSP can assist PARTICIPANT in applying for a Cuban visa from the Cuban government and delivering it before departure. The Cuban Government retains the right to grant or deny visas.
7. CUBAN-BORN PARTICIPANTS
PARTICIPANT acknowledges that the Cuban Government imposes different requirements for Cuban-born persons traveling to Cuba than others, and that such a person obtaining a Cuban visa, if needed, can take a minimum of 8 to 12 weeks.  Cubabien suggests that all Cuban-born persons wishing to participate in the Program contact Cubabien or an authorized Charter Company directly for more information.  Cubabien is not responsible for any information it provides to participants in this regard, or for any delay or denial in the issuance of a Cuban visa, if required. 
8. CHANGES TO PROGRAMS
We endeavor to operate the PROGRAMS as outlined herein. However, circumstances beyond our control may require an adjustment to the PROGRAMS or its inclusions. We strive to avoid such changes, but must reserve the right to make such modifications. If a PARTICIPANT cancels his or her participation in the PROGRAMS because of a PROGRAMS change, normal cancellation penalties will apply.
*We must reserve the right to substitute hotels if necessary. 
9. TRAVELERS REQUIRING SPECIAL ASSISTANCE
PARTICIPANT must report any disability requiring special attention at the time a reservation is requested. CUBABIEN will make reasonable attempts to accommodate the special needs of such PARTICIPANT, but does not guarantee this, and is not responsible for any denial of services by airline charter companies, Cuban carriers, hotels, and other independent suppliers. CUBABIEN regrets that it cannot provide individual assistance to a PARTICIPANT for walking, dining, getting on and off motor coaches, ships and other transportation vehicles, or assist with other personal needs. PARTICIPANTS who need such assistance must be accompanied by a qualified companion who is also a PARTICIPANT in the PROGRAM.  
10. AGE POLICY
Due to the educational and cultural nature of our people-to-people exchanges, participants on Cubabien programs should be at least 18 years-old. Exceptions may be made on a case-by-case basis. 

11. VIsa 

Tourist Visa (Tourist Card)

TOURIST CARDS ARE NOT VALID FOR INDIVIDUALS BORN IN CUBA.  FOR THOSE INDIVIDUALS BORN IN CUBA THE VISA ENTRY PROCESS IS DIFFERENT AND YOU MAY CONTACT US AT VISA@CUBABIENTRAVEL.COM  FOR FURTHER INFORMATION ON THE PROCESS.


Applying for Tourist Card/Visa

The required tourist visa, known as a tourist card, allows the holder to stay in the Cuba for 30 days and is valid for a single entry. You must provide proof of confirmed return flight and booked accommodation.

To apply for tourist card/visa you must follow the procedures set out on our website. All applications must be placed at least 7 business days from the designated departure date.  For exigent circumstances and travel within 7 business days please contact Cuba Bien Travel direct so that the appropriate shipping can be indicated


Visa Shipping Information

All shipped visas will be done so utilizing Usps so that a tracking number may generate.  It is important that the appropriate shipping method (preferred shipping estimated time) is chosen and the correct corresponding payment amount is enumerated at the time of payment.  CBT is not responsible for incorrect shipping information chosen as it relates to the purported date of travel which may lead to a shipping delay.

CBT is entitled to refuse any application made by you. We do not guarantee to successfully process every request. In the event that we are unable to process your application, we will send an email to advise you of that fact. An alternative may be offered which may include additional charges. If your order is processed, we will acknowledge it in the e-mail address you have given us.

You confirm that all details you provide to us for the purpose of purchasing the Tourist card and that will be correct. You accept responsibility for any mistakes made on the tourist cards due to the provision of incorrect information.

You confirm that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the Service. CBT reserves the right to obtain validation of your credit or debit card details before providing you with the Service. If validation cannot be obtained and payment is not made, we reserve the right to cancel the application on behalf of the Supplier concerned that will then not perform the Service.


Prices and Payments

Details of the prices for the Service and the procedures for payment and delivery are displayed on our website. The applicable price of any Service is the price displayed on our website at the date and time of your order. The price of any Service on our website may change before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure

We will inform you if a Service’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the Service at the correct price.


Cancellations

If you cancel the order prior to shipping of the travel card visa, you will receive a refund of all monies you have paid. A refund will made direct to the form of original payment only. All refunds requests must be provided in writing within 30 days of original purchase date to be eligible for refund.

Prices quoted are per person and per individual visa

You must pay by credit or debit card at the time of order as set out on the order page of our website. The cards we accept are set out on the payment page of our website.

Cuba Tourist Card/Visa is non-transferable and non-refundable once it has been issued. Any cancellation or amendment request must be sent to us in writing, by emailing visa@cubabientravel.com, and it will take effect from the day of receipt.  We cannot cancel or amend any tourist card that has already been shipped. Amendments and cancellations can only be accepted in accordance with the terms and conditions.


Limitation on Actions

(a) All claims for refunds, credits, losses or otherwise by Customer against CBT relating to hotel accommodations, must satisfy both of the following conditions: (i) a report of the incident shall have been made in writing and received by the hotel or tour guide (as applicable) during the stay giving rise to the claim, and (ii) the claim shall have be made in writing and received by CBT within seven (7) calendar days after the completion of the trip giving rise to the claim. (b) All claims for refunds, credits, losses or otherwise by Customer against CBT relating to matters other than hotel accommodations, shall have been made in writing and received by CBT within seven (7) calendar days after the completion of the trip giving rise to a claim. (c) Notwithstanding applicable statute of limitations, all suits against CBT relating to the Services must be filed and properly served on CBT, within one (1) year from the date of event giving rise to the action. (d) The failure of Customer to timely make a report or claim, or file suit will be a complete defense to any suit or action commenced by Customer relating to the Services. Further, the failure of Customer to timely make a report or claim will be a complete defense to Customer’s refusal to pay for any of the Services, including, without limitation, disputing credit card charges for the same. (e) Customer may not make any claim or commence any suit against CBT unless and until Customer has paid for the Services in full. (f) All claims against CBT are subject to the other disclaimers, limitations on liability, qualifications and conditions set forth in the Agreement.



Intellectual property rights

The content of our website including without limitation all information are protected by copyright, trademarks, service marks, patents or other proprietary rights.

Except insofar as expressly permitted in these terms and conditions, the content of this website may not be retrieved, displayed, modified, copied, printed, sold, downloaded, sold, hired, reverse engineered or transmitted in any way without our prior written consent.


Data protection.

Personal information collected from you is subject to our privacy policy.

These terms and conditions constitute the entire agreement between you and Cuba Bien Travel in connection with the use of this website.  If any part of this agreement is deemed ineffective for any reason, the parties nevertheless agree that the State court of Florida should be the prevailing court of authority for any dispute resolution and to give effect to the parties’ intentions as reflected in that part and those other parts remain in full force and effect.   This contract is governed by the State law of Florida, USA
